4NE Kullanım Koşulları

Bu koşullar, Taner Işıldak (“4NE”, “biz”) tarafından sunulan 4NE iPhone uygulamasını (“Uygulama”) kullanımını düzenler. Uygulamayı kullanarak bu koşulları ve Gizlilik Politikası’nı kabul etmiş olursun.

1. Kimler kullanabilir?

Uygulamayı kullanmak için 18 yaşında ya da daha büyük olmalısın; bunu ve bu koşulları ilk girişte Uygulama içinde onaylarsın. Hesabını başkasıyla paylaşmamalı, hesabındaki işlemlerden sen sorumlu olmalısın.

2. Uygulama ne yapar, ne yapmaz?

4NE, koleksiyonerlerin sahip oldukları ve aradıkları ürünleri listelemesine, eşleşmesine, mesajlaşmasına ve satış, takas ya da kiralama için birbirine teklif vermesine aracılık eden bir platformdur.

• 4NE, kullanıcılar arasındaki alışverişin tarafı değildir; ürün satmaz, almaz, kiralamaz ve ödeme almaz.
• Ödeme, teslimat, iade ve ürünün durumu tamamen alıcı ve satıcı arasındadır.
• Ürünlerin gerçekliğini, durumunu, yasallığını ya da kullanıcıların söylediklerinin doğruluğunu garanti etmeyiz.
• Katalogdaki ürün bilgileri ve görseller bilgilendirme amaçlıdır; hata içerebilir.

Alışveriş yaparken dikkatli ol: tanımadığın kişilere peşin ödeme yapmadan önce iyi düşün, mümkünse güvenli ödeme ve teslim yöntemleri kullan.

Uygulama, oyuncuların ortak oyunlar üzerinden birbiriyle tanışmasına da aracılık edebilir. 4NE, kullanıcılar arasındaki görüşme ve buluşmaların tarafı değildir ve kullanıcıların kimliğini doğrulamaz. Tanımadığın biriyle yüz yüze buluşacaksan kalabalık ve herkese açık bir yer seç, bir yakınına haber ver ve kendini rahatsız hissedersen buluşmayı sonlandır.

3. Kurallar

Uygulamada şunları yapmamalısın:

• sahte, taklit, çalıntı ya da satışı yasak ürünleri listelemek veya teklif etmek,
• başkalarını dolandırmak, yanıltmak ya da sahip olmadığın bir ürünü varmış gibi göstermek,
• taciz, tehdit, nefret söylemi, müstehcen ya da hakaret içeren mesaj veya içerik göndermek,
• istenmeyen toplu mesaj (spam) ya da reklam göndermek,
• başka birinin kişisel bilgilerini izinsiz paylaşmak,
• kullanıcı adında ya da isimde marka, telif veya ticari unvan hakkıyla korunan adları, tanınmış kişileri ya da 4NE’yi taklit etmek,
• oyuncularla tanışma özelliklerini ücretli hizmet, taşımacılık, konaklama ya da başka ticari amaçlarla kullanmak,
• Uygulamanın güvenliğini aşmaya, sistemlerine zarar vermeye ya da otomatik araçlarla veri toplamaya çalışmak.

Kurallara uymayan kullanıcıları ve içerikleri şikâyet edebilir, kullanıcıları engelleyebilirsin. Şikâyetleri inceleriz.

4. İçeriklerin

Profiline, ilanlarına ve mesajlarına eklediğin içeriklerden sen sorumlusun. Katalog için gönderdiğin fotoğrafların sana ait olduğunu ya da kullanma hakkına sahip olduğunu kabul edersin. Onaylanan fotoğrafları Uygulamadaki katalogda ürün görseli olarak kullanmamız, kırpmamız ve boyutlandırmamız için 4NE’ye dünya çapında, süresiz, ücretsiz ve devredilemez bir kullanım izni verirsin. Fotoğraflar “4NE topluluğu” atfıyla gösterilir.

5. Moderasyon ve hesabın kapatılması

Bu koşullara aykırı içerikleri kaldırabilir, hesapları geçici ya da kalıcı olarak kısıtlayabilir veya kapatabiliriz. Hesabını istediğin zaman Uygulama içinden silebilirsin.

6. Sorumluluğun sınırlanması

Uygulama “olduğu gibi” sunulur; kesintisiz ya da hatasız çalışacağını garanti etmeyiz. Yürürlükteki mevzuatın izin verdiği ölçüde, kullanıcılar arasındaki alışverişlerden, kullanıcıların davranışlarından ya da içeriklerinden doğan zararlardan sorumlu değiliz.

7. Değişiklikler

Bu koşulları güncelleyebiliriz. Önemli değişiklikleri Uygulama içinden duyururuz. Değişiklikten sonra Uygulamayı kullanmaya devam etmen, güncel koşulları kabul ettiğin anlamına gelir.

8. Uygulanacak hukuk ve iletişim

Bu koşullara Türkiye Cumhuriyeti hukuku uygulanır; tüketici olarak sahip olduğun zorunlu haklar saklıdır. Soruların için: [email protected]

4NE Terms of Use

These terms govern your use of the 4NE iPhone app (the “App”) provided by Taner Işıldak (“4NE”, “we”). By using the App you accept these terms and the Privacy Policy.

1. Who can use the App

You must be 18 or older to use the App; you confirm this and accept these terms in the App when you first sign in. Do not share your account with others; you are responsible for activity on your account.

2. What the App does and does not do

4NE is a platform that helps collectors list the items they own and want, get matched, message each other and make offers to buy, trade or rent items between themselves.

• 4NE is not a party to deals between users; we do not sell, buy or rent items and we do not take payments.
• Payment, delivery, returns and the condition of items are entirely between buyer and seller.
• We do not guarantee the authenticity, condition or legality of items, or the accuracy of what users say.
• Catalog information and images are for reference and may contain errors.

Be careful when dealing: think twice before paying people you do not know in advance, and use safe payment and delivery methods where possible.

The App may also help players meet each other through shared games. 4NE is not a party to conversations or meetings between users and does not verify users’ identities. If you meet someone you do not know in person, choose a busy public place, tell someone close to you, and leave if you feel uncomfortable.

3. Rules

You must not:

• list or offer counterfeit, stolen or prohibited items,
• defraud or mislead others, or pretend to own an item you do not have,
• send harassing, threatening, hateful, obscene or insulting messages or content,
• send spam or unsolicited advertising,
• share another person’s personal information without permission,
• impersonate 4NE, well-known people, or names protected by trademark, copyright or trade name rights in your username or name,
• use features for meeting players for paid services, transport, accommodation or other commercial purposes,
• try to bypass the App’s security, harm its systems or collect data with automated tools.

You can report users and content that break these rules, and block users. We review reports.

4. Your content

You are responsible for the content you add to your profile, listings and messages. By submitting photos for the catalog, you confirm that they are yours or that you have the right to use them. You grant 4NE a worldwide, perpetual, royalty-free, non-transferable licence to use, crop and resize approved photos as product images in the App’s catalog. Photos are credited to “4NE community”.

5. Moderation and account termination

We may remove content that breaks these terms and temporarily or permanently restrict or close accounts. You can delete your account at any time from within the App.

6. Limitation of liability

The App is provided “as is”; we do not guarantee uninterrupted or error-free operation. To the extent permitted by applicable law, we are not liable for damages arising from deals between users or from users’ conduct or content.

7. Changes

We may update these terms. We will announce significant changes in the App. Continuing to use the App after a change means you accept the updated terms.

8. Governing law and contact

These terms are governed by the laws of the Republic of Türkiye; your mandatory consumer rights are not affected. Questions: [email protected]
